International Background of the Amendement in Labor Matters

The amendment that is currently in the Chamber of Deputies, which will modify the way labor relations are performed, has as background the Constitutional reform entered into force in 2017, which was derived from the Trans-Pacific Partnership, signed and ratified by Mexico. Additionally, under the negotiation of the new trade agreement between United States Canada, and Mexico, several obligations were included for Mexico in order to guarantee the freedom of association and collective bargaining. In this sense, experts from Canada, Colombia, United States and Mexico will analyze the background and explain the way in which each country carry out its collective relations: non-unionized workplaces in the United States, multi-union and multi-affiliation in Colombia, the Canadian experience with the signature of ILO’s Convention 98. Additionally, the panelists will analyze the effects for Mexico in case the companies do not comply with the new labor obligations, in terms of the new trade agreements

The Legislative Modifications in Labor Matters

The reform of the Federal Labor Law regarding labor matters will impose a new form in which labor relations will be regulated and carried out. The union will be required to prove that it represents the workers protected by the collective bargaining agreement, from the execution and filing of collective bargaining agreements to the call for strike claiming the execution of the collective bargaining agreement and the Union Certification Process. The union must legitimize itself and work for the workers. On the other hand, the employer cannot perform any act that intervenes in the internal life of the union, either by payments or in any other form. How to apply the new regulations in the Mexican business reality? What implications will the changes have and what changes should companies carry out regarding the collective bargaining agreements currently executed? How much time do companies have to implement their strategies?

The Legislative Modifications in Procedural Rules

An important element of the amendments to the Federal Labor Law is the radical change of the labor justice system. The elimination of the Conciliation and Arbitration Boards and the creation of Labor Courts, as well as the creation of a new labor process that has a conciliatory and a judicial part will have important effects for companies, which should manage their labor trials more efficiently. Through an open and totally practical discussion, our panelists will explain the changes companies must implement in order to face these changes internally.

Treding Labor Law Matters in Latin America

The #MeToo movement, the Millennial and "Z" generation, home office and confidentiality, the effects of Artificial Intelligence and the elimination of job positions, among others, are issues that we currently see in different parts of the world and represent a change in work relationships. Latin America has addressed these issues from different points of view and it seems that they have not had the same impact as in the United States or Europe, so our panelists will analyze these issues and provide practical recommendations on how to develop investigations for harassment cases or internal policies violations.
